Agreement to Terms

These Terms of Service ("Terms") govern your use of ThistleKay Wedding Photography's services and website. By engaging our services or using our website, you agree to be bound by these Terms.

Services

Photography Services

ThistleKay Wedding Photography provides professional wedding photography services including:

• Wedding day photography coverage
• Engagement and pre-wedding sessions
• Destination wedding photography
• Wedding videography services
• Photo editing and retouching
• Digital gallery delivery
• Album design and printing

Booking and Payments

Booking Process

To secure your wedding date, a signed contract and deposit payment are required. Your booking is not confirmed until both are received.

Payment Terms

• A 50% deposit is required to secure your booking
• Remaining balance is due 30 days before the wedding date
• Late payment fees may apply for overdue balances
• All prices are in Malaysian Ringgit (RM)
• Additional services will be billed separately

Cancellation and Refunds

• Cancellations more than 90 days before the wedding: 50% refund of deposit
• Cancellations 30-90 days before: 25% refund of deposit
• Cancellations less than 30 days before: No refund
• Refunds will be processed within 30 business days

Photography Coverage

Coverage Hours

Photography coverage begins and ends at the times specified in your contract. Additional hours beyond the contracted time will be charged at the prevailing hourly rate.

Location and Travel

Services within Greater Kuala Lumpur are included in base pricing. Additional travel fees apply for destinations outside this area. Destination weddings require separate travel and accommodation arrangements.

Client Responsibilities

Cooperation

Clients agree to:

• Provide accurate timeline and venue information
• Cooperate with photographers during the event
• Ensure family members and guests cooperate
• Provide vendor contact information when requested
• Notify us of any special photography requirements

Venue Access

Clients must ensure photographers have unrestricted access to the venue and ceremony areas. We are not responsible for missing coverage due to restricted access.

Delivery and Copyright

Image Delivery

• Edited photos will be delivered within 6-8 weeks after the wedding
• Rush delivery available for additional fee
• Images delivered through secure online gallery
• High-resolution downloads included in all packages

Copyright and Usage

ThistleKay retains copyright to all images but grants clients unlimited personal use rights. Commercial use requires written permission. We reserve the right to use images for:

• Portfolio and website display
• Social media marketing
• Photography publications
• Competition submissions
• Promotional materials

Limitation of Liability

Equipment Failure

While we maintain professional backup equipment, we are not liable for technical failures beyond our control that may affect coverage.

Force Majeure

We are not liable for failure to perform services due to circumstances beyond our control, including but not limited to:

• Natural disasters
• Extreme weather conditions
• Venue restrictions
• Government regulations
• Health emergencies

Liability Limits

Our total liability shall not exceed the amount paid for our services. We are not liable for indirect, consequential, or punitive damages.

Model Release

By engaging our services, clients and their guests consent to being photographed and grant permission for the use of their likeness in our marketing materials.

Editing and Retouching

Standard editing is included in all packages. This includes color correction, exposure adjustments, and basic retouching. Extensive retouching requests may incur additional charges.

Third-Party Vendors

We are not responsible for the actions or services of other wedding vendors. Any disputes with other vendors must be resolved directly with those parties.

Rescheduling

Wedding date changes are subject to our availability. Rescheduling fees may apply, and additional costs for new venues or dates are the client's responsibility.

Dispute Resolution

Any disputes arising from these Terms will be resolved through mediation in Kuala Lumpur, Malaysia, under Malaysian law.

Privacy and Data Protection

Client information is protected according to our Privacy Policy. We comply with applicable data protection laws in Malaysia.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website and apply to future bookings.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, along with your signed photography contract, constitute the entire agreement between parties.
